Le P’tit Loup (“we”, “us”, “our”) operates this website and online store (the “Site”). By accessing the Site and/or making a purchase, you use our services (the “Services”) and agree to be bound by these Terms of Service (the “Terms”), as well as any policies referenced herein (including our Privacy Policy and Return & Refund Policy).
Our store is hosted on Shopify Inc., which provides us with the e-commerce platform.
If you do not agree to these Terms, you must not use the Site.
1) Eligibility & Account
You represent that you have reached the age of majority in Québec and are legally able to enter into purchases using the Site.
You are responsible for maintaining the confidentiality of your account credentials and for the accuracy of your account information. Any activity conducted through your account is deemed to be your responsibility.
We reserve the right to suspend or terminate an account in the event of misuse or violation of these Terms.
2) Online Store & Product Availability
Certain products may be available exclusively online and/or in limited quantities.
We reserve the right to limit sales to any person or region and to modify or discontinue products without notice.
We make reasonable efforts to display product images and colors accurately; however, display may vary depending on your screen or device.
3) Prices, Payments & Taxes
All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes. Prices and fees may change without notice.
Payment is due at the time of order through the payment methods offered by Shopify and its payment providers.
In the event of a pricing or information error, we reserve the right to correct, cancel, or refuse an order. If payment has already been processed, a refund will be issued.
4) Orders, Shipping & Risk
We reserve the right to refuse or limit orders, including suspected fraudulent orders or reseller activity.
Shipping times displayed are estimates only. Delivery is handled by third-party carriers.
Risk of loss transfers to you upon delivery to the shipping address provided.
5) Returns, Exchanges & Refunds
We offer a 60-day no-condition return period following delivery.
To initiate a return, you must contact info@leptitloup.com before sending any item. Returns sent without prior authorization may be refused.
Refund terms and conditions are detailed in our Return & Refund Policy, which forms an integral part of these Terms.
6) User Content (Reviews & Comments)
If you submit reviews, comments, or other content, you grant Le P’tit Loup a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, translate, and display such content in connection with the Services and marketing, subject to applicable laws.
You represent that your content:
(i) does not violate any rights (including intellectual property or privacy),
(ii) is not unlawful, defamatory, obscene, threatening, or misleading, and
(iii) does not contain viruses or malicious code.
We reserve the right to moderate or remove content at our discretion.
7) Third-Party Tools & Services
The Site may include tools, plug-ins, or links provided by third parties (e.g., payment, shipping, analytics, social media).
These third parties operate under their own terms and policies. We are not responsible for their websites, practices, or content.
8) Prohibited Uses
You may not use the Site or Services to:
(a) engage in illegal activities;
(b) infringe on the rights of others;
(c) transmit malicious software;
(d) collect data from other users without authorization;
(e) conduct spam, phishing, or scraping;
(f) bypass security measures;
(g) resell products without prior written authorization.
9) Intellectual Property
The Site and all content—including text, logos, graphics, images, videos, code, and design—are protected and remain the property of Le P’tit Loup or its licensors.
Any unauthorized reproduction, distribution, or modification is strictly prohibited.
10) Accuracy of Information
While we strive for accuracy, errors, omissions, or delays in updating information may occur.
We reserve the right to correct errors and update information (including pricing and availability) at any time without notice.
11) Warranties & Liability
The Services are provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free access.
To the extent permitted by applicable law, we disclaim liability for any indirect, incidental, special, or punitive damages arising from the use of the Services.
Nothing in these Terms limits your mandatory consumer rights, including those provided under Québec’s Consumer Protection Act.
12) Indemnification
You agree to indemnify and hold harmless Le P’tit Loup, its affiliates, and partners from any claim arising out of:
(i) your use of the Services,
(ii) your breach of these Terms, or
(iii) your violation of third-party rights, to the extent permitted by law.
13) Termination
We may suspend or terminate your access to the Services, in whole or in part, at any time if you violate these Terms.
Provisions that by their nature should survive termination (e.g., intellectual property, liability limitations) shall remain in effect.
14) Governing Law & Disputes
These Terms are governed by the laws of Québec and the applicable federal laws of Canada.
Any dispute shall be submitted to the competent courts of Québec, judicial district of Montréal, subject to mandatory consumer protection rules.
15) Changes to These Terms
We may update these Terms from time to time for operational, legal, or regulatory reasons. The updated version will be posted with the revision date.
Continued use of the Site after publication constitutes acceptance of the changes.
16) Electronic Communications
By providing your email address and using the Services, you consent to receive electronic communications related to your orders, account, and policies.
You may manage your preferences for promotional communications (unsubscribe) without affecting transactional messages.
17) Force Majeure
We shall not be liable for delays or failure to perform resulting from events beyond our reasonable control (force majeure).
18) Entire Agreement & Severability
These Terms, together with the incorporated policies (Privacy, Returns), constitute the entire agreement between you and us regarding the Services.
If any provision is deemed invalid, it shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
